In this article, we discuss a number of challenges with the empirical study of emotion and its relation to moral judgment. We examine a case study involving the moral foreign-language effect, according to which people show an increased utilitarian response tendency in moral dilemmas when using their non-native language. One important proposed explanation for this effect is that using one’s non-native language reduces emotional arousal, and that reduced emotion is responsible for this tendency. We offer reasons to think that there (...) is insufficient evidence for accepting this explanation at present. We argue that there are three themes that constrain our current ability to draw firm empirical conclusions: 1) the frequent use of proxies or partial measures for emotions, 2) the lack of a predictive and generalizable theory of emotion and specific emotion-types, and 3) the obscurity of a baseline level of neutrality with respect to participant emotion. These lessons apply not only to research on the moral foreign-language effect, but to empirical research in moral psychology more generally. (shrink)

The majority of research on how learning a second language (L2) has focused on the personal benefits of being bilingual or multilingual. In this paper, we focus on the potential positive effect of actively thinking in L2. Our approach is inspired by recent experimental research suggesting that actively thinking in an L2 leads to improved reasoning and decision-making, which is known as the foreign-language effect (FLE). We examine the possibility that one could selectively engage in L2 thinking in order to (...) reap these potential benefits. Integrating this research with research in positive psychology, we explain how doing so might be understood as a type of “nudge,” or intervention that one could use to increase their chances of making autonomous decisions reflecting their own best interest. Nudges have been associated with improved outcomes with respect to many aspects of our lives - for instance sticking to goals, saving money, exercising more frequently, maintaining a healthy diet. It may be that bilinguals can assume an active role in increasing their happiness or well-being by making better decisions through strategic implementation of L2 in decision-making contexts. We also discuss the ethics of using the FLE as a nudge when it has beneficial consequences, as there are instances when doing so could be beneficial with respect to public policy as well. For instance, it has been shown that people are less averse to sustainable farming and eating practices (e.g. eating insects) when actively thinking in an L2. After reviewing the current research on the FLE, we suggest that further research needs to be done because actively thinking in L2 seems to function beneficially in some circumstances but may pose cognitive disadvantages in others. Many have argued that moral judgment is driven by one of two types of processes. Rationalists argue that reasoned processes are the source of moral judgments, whereas sentimentalists argue that emotional processes are. We provide evidence that both positions are mistaken; there are multiple mental processes involved in moral judgment, and it is possible to manipulate which process is engaged when considering moral dilemmas by presenting them in a non-native language. The Foreign-Language Effect is the activation of systematic reasoning processes (...) by thinking in a foreign language. We demonstrate that the FLE extends to moral judgment. This indicates that different types of processes can lead to the formation of differing moral judgments. One implication of the FLE is that it raises the possibility that moral judgments can be made more systematic, and that the type of processing used to form them might be relevant to normative and applied ethics. By making plausible the Diversity Thesis (different people have systematically different and incompatible packages of epistemic intuitions), experimental epistemology raises the specter of the shifting-sands problem: the evidence base for epistemology contains systematic inconsistencies. In response to this problem, some philosophers deny the Diversity Thesis, while others flirt with denying the Evidence Thesis (in normal circumstances, the epistemic intuition that p is prima facie evidence that p is true). We propose to accept both theses. The trick to living with the (...) shifting-sands problem is to expand epistemology’s evidential base so as to include scientific evidence. This evidence can provide principled grounds on which to decide between incompatible intuitions. The idea of resolving inconsistencies in an evidential base by adding more independent lines of evidence is commonplace in science. And in philosophy, it is simplyWide Reflective Equilibrium.We contend that the idea that epistemology would depend crucially on scientific evidence seems radical because many traditional epistemologists practice reflective equilibrium that is WINO, Wide In Name Only. We suggest five different lines of scientific evidence that can be, and have been, used in support of non-WINO epistemological theories. (shrink)

A meta-analytic review of studies that experimentally elicited awe and compared the emotion to other conditions (84; 487 effects; 17,801 participants) examined the degree to which experimentally elicited awe (1) affects outcomes relative to other positive emotions (2) affects experience, judgment, behaviour, and physiology, and (3) differs in its effects if the awe state was elicited through positive or threatening contexts. The efficacy of methods that have been used to experimentally elicit awe and the possibility of assessing changes in the (...) state of the self with experimental awe elicitations were also examined. Meta-analyses with robust variance estimation revealed that awe affected outcomes compared to other positive emotions and control conditions; affected experience, judgment, and behaviour; and had similar effects if elicited through positive or threatening contexts. The ability to compare awe to negative emotion states and its effects on physiology was limited by a small number of available effects. Images, videos, autobiographical recall, and naturalistic exposure were effective in eliciting awe. Exploratory analyses suggested that some processes involved in changes in the self can be related to experimental awe elicitations. These findings suggest awe is a discrete emotion and identifies areas for future investigation. (shrink)

The ethics of deceased organ procurement (OP) is supposedly based on individual consent to donate, either explicit (opt-in) or presumed (opt-out). However, in many cases, individuals fail to express any preference regarding donation after death. When this happens, the decision to remove or not to remove their organs depends on the policy’s default option or on family preferences. Several studies show that in most countries the family plays a significant and often decisive role in the process of decision-making for OP. (...) Depending on the country, the family may be allowed to take different kinds of actions in different situations, and this may be granted either by law or by clinical practice only. This adds much complexity to the usual classification of consent policies in two categories: opt-in and opt-out. Here we propose a novel and comprehensive taxonomy of the models of consent for OP according to three variables: (1) the deceased’s wishes, if any, (2) family wishes, if any, and (3) default policies. By analysing these models of consent, we show that they rely on at least three different concepts of autonomy: individual autonomy, relational autonomy, and family autonomy. In light of this analysis, we discuss the ethical debates surrounding two policy approaches: presumed consent and family veto. (shrink)

Almost two decades on, we reflect on the legacy of the feminist critique of bioethics and investigate the extent to which it has been successful and what requires more attention yet. We do this by examining the past, present, and future: we draw out three feminist concerns that emerged in this period—abstraction, individualism, and power—and consider three feminist responses—relationality, particularity, and justice—and we finish with some thoughts (...) about the future. ABSTRACTThe private provision of security services has attracted a great deal of recent attention, both professional and popular. Much of that attention suggests the questioned moral legitimacy of the private vs. public provision of security. Linking the literature on moral legitimacy and responsibility from new institutional and stakeholder theories, we examine the relationship between moral legitimacy and responsible behavior by both private security companies and their stakeholders. We ask what the moral-legitimacy-enhancing responsibilities of both might be, and contribute to both (...) literatures and their managerial implications by detailing the content of those responsibilities, emphasizing the reciprocal nature of moral obligations. We suggest that the moral legitimacy of the industry depends upon responsible behavior by both PSCsandtheir stakeholders. (shrink)

The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. ABSTRACT:This essay attempts to provide a useful research agenda for researchers in both strategic managementandbusiness ethics. We motivate this agenda by suggesting that the two fields started with similar interests, diverged, and are beginning to converge again. We then identify several streams that hold particular promise for developing our understanding of the relationship between strategy and ethics: stakeholder theory, managerial discretion, behavioral strategy, strategy as practice, and environmental sustainability.

Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

COVID-19 continues to dominate 2020 and is likely to be a feature of our lives for some time to come. Given this, how should health systems respond ethically to the persistent challenges of responding to the ongoing impact of the pandemic? Relatedly, what ethical values should underpin the resetting of health services after the initial wave, knowing that local spikes and further waves now seem inevitable? In this editorial, we outline some of the ethical challenges confronting those running health services (...) as they try to resume non-COVID-related services, and the downstream ethical implications these have for healthcare professionals’ day-to-day decision making. This is a phase of recovery, resumption and renewal; a form of reset for health services.1 This reset phase will define the ‘new normal' for healthcare delivery, and it offers an opportunity to reimagine and change services for the better. There are difficulties, however, healthcare systems are already weakened by austerity and the first wave of COVID-19 and remain under stress as the pandemic continues. The reset period is operating alongside, rather than at the end, of the pandemic and this creates difficult ethical choices. ### Balancing the greater good with individual care Pandemics—and public health emergencies more generally—reinforce approaches to ethics that emphasise or derive from the interests of communities, rather than those grounded in the claims of the autonomous individual. The response has been to draw on more public health focused ethics, ‘if demand outstrips the ability to deliver to existing standards, more strictly utilitarian considerations will have to be applied, and decisions about how to meet the individual's need will give way to decisions about how to maximise overall benefit’.2 Alongside this, effective …. This work gives a new argument for ‘Empirical Philosophy of Mathematical Practice’. It analyses different modalities on how empirical information can influence philosophical endeavours. We evoke the classical dichotomy between “armchair” philosophy and empirical/experimental philosophy, and claim that the latter should in turn be subdivided in three distinct styles: Apostate speculator, Informed analyst, and Freeway explorer. This is a shift of focus from the source of the information towards its use by philosophers. We present several examples from philosophy of mind/science (...) and ethics on one side and a case study from philosophy of mathematics on the other. We argue that empirically informed philosophy of mathematics is different from the rest in a way that encourages a Freeway explorer approach, because intuitions about mathematical objects are often unavailable for non-mathematicians. At the 2022 Central American Philosophical Association meeting, there was an Author-Meets-Critics session on Carolyn McLeod’s book, Conscience in Reproductive Health Care: Prioritizing Patient Interests. The event was organized and chaired by Heather Stewart and sponsored by the APA Committee on the Status of Women and Kate Norlock, chair of that committee. There were four speakers, including McLeod and three “critics”: Javiera Perez Gomez, Alison Reinheld, and Jennifer Parks, who were all generous enough to provide McLeod with their (...) comments beforehand. The sessions occurred over Zoom even though some speakers were present in person at the conference. McLeod kicked things off by providing a summary of her book, which was then followed by critical comments by the critics in the order in which they’re named above. The idea that fictions may educate us is an old one, as is the view that they distort the truth and mislead us. While there is a long tradition of passionate assertion in this debate, systematic arguments are a recent development, and the idea of empirically testing is particularly novel. Our aim in this chapter is to provide clarity about what is at stake in this debate, what the options are, and how empirical work does or might bear on its (...) resolution. We distinguish between merely influencing people’s opinions and providing genuine learning, where the latter requires that the source of the change in opinion should be reliable. Other important ideas here are the extent to which authors of fiction may be considered to provide testimony, or something like it, and the possibility of recognizing an unstated purpose in the project of the fictional work. We ask whether fictions can furnish us not merely with ideas but with reasons for believing them, perhaps by constituting thought experiments. We consider whether the focus should be on understanding rather than on knowledge, and whether fictions can inform us about the qualities of another’s experiences. We briefly describe some experimental work of recent decades and suggest that the evidence for learning from fiction is currently meagre. (shrink)

Abstract:This paper utilizes a qualitative case study of the health care industry and a recent legal case to demonstrate that stakeholder theory’s focus on ethics, without recognition of the effects of incentives, severely limits the theory’s ability to provide managerial direction and explain managerial behavior. While ethics provide a basis for stakeholder prioritization, incentives influence whether managerial action is consistent with that prioritization. Our health care examples highlight this and other limitations of stakeholder theory and demonstrate the explanatory and directive (...) power added by the inclusion of the interactive effects of ethics and incentives in stakeholder ordering. Topics related to ethical issues in agricultural production, particularly farm animal welfare, are increasingly featured in mainstream news media. Media representations of farm animal welfare issues are important because the media is a significant source of information, but also because the way that the issues are represented, or framed, defines these issues in particular ways, suggests causes or solutions, and provides moral evaluations. As such, analysis of media frames can reveal how issues are being made public and identify the cues (...) that audiences are given to help them make sense of complex ethical issues. Previous research on media frames and animal welfare has tended to focus on single issues or events; however we sought to identify whether media frames extended across different farm animal welfare-related issues to investigate whether there is any commonality between issues. We analysed articles published in the mainstream press in Australia between 2014 and 2016 related to farm animal welfare, and identified two dominant frames: that governments and the farm animal production industries cannot be trusted to ensure good farm animal welfare; and that consumers can act to improve animal welfare through ethical consumption. These frames have implications for how the Australian public interpret and understand the roles and responsibilities of different actors in the food production system. This research also contributes to discussion about the role of the media in shaping public opinion about ethical issues in agriculture and how, in turn, the media landscape itself is being shaped by consumer attitudes. The divergence point analysis procedure is aimed at obtaining an estimate of the onset of the influence of an experimental variable on response latencies (e.g., fixation duration, reaction time). The procedure involves generating survival curves for two conditions, and using a bootstrapping technique to estimate the timing of the earliest discernible divergence between curves. In the present paper, several key extensions for this procedure were proposed and evaluated by conducting simulations and by reanalyzing data from previous studies. Our findings indicate (...) that the modified versions of the procedure performed substantially better than the original procedure under conditions of low experimental power. Furthermore, unlike the original procedure, the modified procedures provided divergence point estimates for individual participants and permitted testing the significance of the difference between estimates across conditions. The advantages of the modified procedures are illustrated, the theoretical and methodological implications are discussed, and promising future directions are outlined. (shrink)

A supertask is a process in which an infinite number of individuated actions are performed in a finite time. A Newtonian supertask is one that obeys Newton's laws of motion. Such supertasks can violate energy and momentum conservation and can exhibit indeterministic behavior. Perez Laraudogoitia, who proposed several Newtonian supertasks, uses a local, i.e., particle-by-particle, analysis to obtain these and other paradoxical properties of Newtonian supertasks. Alper and Bridger use a global analysis, embedding the system of particles in a (...) Banach space, to determine the origin of the strange behavior. This paper provides a common framework for the discussion of both the local and global methods of analysis. Using this single framework, the areas of disagreement and agreement are made explicit. Further examples of supertasks are proposed to illuminate various aspects of the discussion. (shrink)

Como parte del trabajo del taller interno permanente del Cuerpo Académico de Estética y Arte de la Benemérita Universidad Autónoma de Puebla, el 12 de noviembre de 2013 se realizó una Mesa Redonda sobre el tema “Universalidad e identidad cultural”. En esta Mesa participaron los doctores José Ramón Fabelo Corzo, José Antonio Pérez Diestre y Ramón Patiño Espino, como ponentes principales; además, se contó con la asistencia del doctor Jesús Márquez Carrillo, quien se integró al debate. Diferentes disciplinas —la filosofía, (...) la antropología, la historia del pensamiento y del arte, incluso la biología— pueden, cada una, ofrecer sus aportes al tan socorrido tema de la relación entre lo universal y lo propio en la cultura latinoamericana. El debate suscitado puso de manifiesto esa diversidad de aportaciones. Las crisis económicas están generando desigualdades, producto de la violencia estructural; éstas están derivando en las maneras en que los jóvenes construyen y dibujan los sentidos sociales. Los jóvenes deberían ser sujetos que se mueven en toda una temporalidad sin embargo, sus condiciones materiales de vida, no les permiten pensar en un futuro con certezas. Más bien, éstas se desdibujan para ellos y hoy más que nunca aparecen sus sueños postergados y aplazados por la propia violencia de la que son (...) objeto. De ahí, nuestro interés en ver cómo los jóvenes egresados de la universidad, están construyendo dichos sentidos.Economic crises are generating inequalities resulting from structural violence; they are drifting in the ways in which young people build and draw social senses. Young people should be the subjects of movement along temporariness; nevertheless, their material living conditions do not allow them to think in their future with certainty. For our young generations these conditions are blurred, and now more than ever their dreams are deferred and delayed by the violence they are subjected to. Hence, our interest in finding out how young university graduates are building these senses. (shrink)

BackgroundInformed consent is an important factor in a child’s moral structure from which different types of doctor–patient relationships arise. Children’s autonomy is currently under discussion in terms of their decent treatment, beyond what doctors and researchers perceive. To describe the influential practices that exist among clinicians and researchers toward children with chronic diseases during the process of obtaining informed consent.MethodsThis was a cross-sectional, qualitative study via a subjective and interpretivist approach. The study was performed by conducting semi-structured interviews of 21 (...) clinicians and researchers. Data analysis was performed using the SPSS version 21® and Atlas Ti version 7.0® programs.ResultsThe deliberative and paternalistic models were influential practices in the physician–patient relationship. In the deliberative model, the child is expected to have a moral awareness of their care. The paternalistic model determined that submission was a way of structuring the child because he or she is considered to be a subject of extreme care.ConclusionsThe differentiated objectification [educational] process recognizes the internal and external elements of the child. Informed consent proved to be an appropriate means for strengthening moral and structuring the child. (shrink)

A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. Con base en ello estaríamos en condición de acercarnos a la visión doxástica moderada que han defendido autoras como Lisa Bortolotti. (shrink)

El presente trabajo trata de demostrar que a la luz del concepto de ‘hombre entero’o ‘personalidad’ de Simmel se revela cierto isomorfismo estructural entre el hombre éticokantiano y el hombre económico moderno. Para ello, se analiza en primer lugar la críticaque Simmel dirige desde dicho concepto contra la concepción antropológica presupuesta enla ética de Kant. En segundo lugar, se examina la relación que se genera entre el hombre yla cultura como consecuencia del desarrollo de la economía monetaria y de lo (...) que Simmeldenomina ‘tragedia de la cultura’, tratando de demostrar que dicha relación produce untipo de individualidad que, sobre el trasfondo del hombre entero, se evidencia equivalentea la presupuesta en la ética de Kant. Resumen: Diez años después de la muerte de Franco, la escritora catalana Maria Barbal publicó Pedra de tartera, una novela sobre la trayectoria vital de una campesina del Pirineo marcada por la Guerra Civil española. El objetivo de este artículo es demostrar que el éxito local e internacional de la obra reside en la capacidad de la voz narrativa por rememorar el pasado desde el posicionamiento ético en contra de los seculares poderes patriarcales y el compromiso con la denuncia de (...) la condición de la mujer. La obra de Barbal ha merecido una atención académica poco significativa, que además no ha profundizado en su dimensión de relato de guerra. Con el fin de situar Pedra de tartera en el corpus de narrativas de la memoria que abordan la Guerra Civil, proponemos una exégesis que pone el foco en el reconocimiento de la violencia patriarcal, bélica y postbélica que sufre la protagonista.: Ten years after Franco’s death, the Catalan writer Maria Barbal published Stone in a Landslide, a novel about the life story of a peasant woman of the Pyrenees marked by the Spanish Civil War. The aim of this paper is to prove that local and international success of the work lies in the ability of the narrative voice to remember the past from the ethical stance against the secular patriarchal powers and commitment to denouncing the woman’s condition. The work of Barbal still has not had the academic attention that it deserves, especially as a war narrative. In order to place Stone in a Landslide in the corpus of the narrative of memory addressing Civil War, we propose an exegesis that places the focus on the recognition of patriarchal, war and postwar violence suffered by the protagonist. Children remain largely absent from sociolegal scholarship on sexual violence. Taking an intersectional approach to the analysis of attorneys’ strategies during child sexual assault trials, this article argues that legal narratives draw on existing gender, racial, and age stereotypes to present legally compelling evidence of credibility. This work builds on Crenshaw’s focus on women of color, emphasizing the role of structures of power and inequality in constituting the conditions of children’s experiences of adjudication. Using ethnographic observations of courtroom jury trials, (...) transcripts, and court records, three narrative themes of child credibility emerged: invisible wounds, rebellious adolescents, and dysfunctional families. Findings show how attorneys use these themes to emphasize the child’s unmarked body, imperceptible emotional responses, rebellious character, and harmful familial environments. The current study fills a gap in sexual assault research by moving beyond trial outcomes to address cultural narratives within the court that are inextricably embedded in intersectional dimensions of power and the reproduction of social status. Cet article soutient que les voitures autonomes sont des robots sociaux qui doivent agir comme des tenants-lieux de leurs propriétaires humains. Pour ne pas esquiver les choix moraux incombant aux utilisateurs humains de ces technologies, on pourrait programmer les véhicules de façon à ce qu’ils puissent se comporter selon différentes théories morales, en permettant aux propriétaires de choisir celle qui a leur préférence. L’article envisage également les implications éthiques d’autres problèmes pratiques liés à la technologie des voitures autonomes.

This article analyzes some of the reasons that led to the adoption of vernacular languages as philosophical languages between the 14th and 17th centuries in France and Italy. The article focuses on Descartes’s Discours de la méthode (1637), Sperone Speroni’s Dialogo delle lingue (1542) and Dante Alighieri’s Convivio (circa 1304-1307). The three works not only chose to write philosophy in a language with no philosophical tradition, but also offered a philosophical rationale for this decision. El propósito de este texto es aclarar la dirección, los alcances y los límites del análisis filosófico según lo concibe Peter Strawson en Análisis y metafísica. Para el autor el análisis filosófico asume la forma de una metafísica descriptiva, esto es, de una teoría que exhibe cuáles son, y cómo se relacionan, los distintos elementos que componen nuestro esquema conceptual ordinario. Bridger and Alper (1999) maintain that the nonphysical featuresof the supertasks described by Pérez Laraudogoitia (1996) involving a system containing an infinite number of particles may be avoided by introducing, in a specific way, Hilbert space in classical dynamics. I argue that it is possible to interpret their proposal in two ways, neither of which is acceptable for the purpose for which it was introduced.

This exploratory qualitative study investigated how doctoral students reported their personal and professional interaction experiences that they believed might facilitate or impede their academic pursuits in biomedical research. We collected 19 in-depth interviews with doctoral students in biomedical research from eight universities, and we based our qualitative analytic approach on the work of Miles and Huberman. The results indicated that among different sources and types of interaction, academic and emotional interactions from family and teachers in various stages essentially affected students’ (...) persistence in the biomedical science field. In addition, co-mentorship among peers, departmental environment, and volunteer experiences were other essential factors. This study also found related experiences among women and underrepresented minority students that were important to their academic pursuit. (shrink)

We give $A_p$ type conditions which are sufficient for two-weight, strong $$ inequalities for Calderón-Zygmund operators, commutators, and the Littlewood-Paley square function $g^*_\lambda $. Our results extend earlier work on weak $$ inequalities in [13].
